The Interplay between the European Union Intellectual Property and Competition Law in the Digital Economy

Absztrakt

The thesis discusses the interaction between intellectual property and competition law and policy in the European Union within the digital economy. Common areas touched by both disciplines, but also common drives behind the creation of the separate legal areas are addressed. It has been concluded that digital economy is not ripe enough to distinguish itself from the existing frame work of IP/competition interplay. This existing framework, mainly consisting of refusal to license, territorial exclusivities created by IP transactions could address digital economy questions as they stand out today. However, online music content provision industry may be assimilated to collecting societies and their dominant position could facilitate the application of the existing IP/competition interplay framework in digital economy cases.
