Ist die COVID-19-Krankheit wirklich eine technische Frage seitens des Rechtsanwalts?

Abstrakt: Im Frühjahr 2020 hat die COVID-19-Pandemie unser tägliches Leben völlig abändert. Viele der Auswirkungen der Abschließungen und der Heimarbeit, die mit der Epidemie einhergingen, sind auch heute noch in der Gerichtspraxis zu spüren, sowohl positiv als auch negativ. Positiv zu vermerken ist, dass die Gerichte und Behörden das Potenzial der Online-Kommunikation erkannt haben, so dass einige Verfahren auch in den „Epidemiefreien” Zeiten, online abgehalten werden können, was Zeit und Energie spart. Die Tatsache, dass die Gerichte in Zivilverfahren immer mehr ausschließlich schriftliches Vorverfahren anordnen, viel öfter als früher, löst unterschiedliche Reaktionen aus.  Schließlich als negatives Beispiel ist zu nennen dass es bisher zu keine zufriedende Lösung kam, wie das Gericht mit Fällen von Abwesenheit aufgrund plötzlicher Krankheit einen Umgang finden kann. Die Abhandlung untersucht die Praxis im Bereich der Abwesenheit im Krankheitsfall: Auf der Grundlage eines Beschlusses des ungarischen höchsten Gerichtshofes (der sog. Kuria) vom Februar 2021, der unter den besonderen Umständen des Pandemie-Notfalls erlassen wurde, versucht sie, den tatsächlichen Inhalt und die Rolle des Rechts auf Vertretung (und die Vertretung durch einen Anwalt) in Zivilverfahren zu beleuchten.
Abstract: The COVID-19 pandemic has disrupted our daily lives in spring 2020. Many of the effects of the closures and home-working practices that accompanied the epidemic are still being felt in civil procedure today, whether positive or negative. On the positive side, the courts and authorities have recognised the potential of online communication, so that some of the proceedings can be moved online even in periods when there is no epidemic, saving time and energy. There are mixed views on the benefits of the fact that courts are ordering more only written preparation for the commencement of civil litigation proceedings than in the past. Lastly, it is negative that, to date, no satisfactory solution has been found for dealing with cases of absence due to sudden illness. This study examines the practice in the field of sickness absence: on the basis of an order of the Hungarian High Court (Curia) of February 2021, issued under the specific circumstances of a case of emergency, it seeks to shed light on the real content and role of the right to representation (and the substitution of the attorney) in civil proceedings.
Absztrakt: A COVID-19 világjárvány felforgatta mindennapi életünket 2020 tavaszán. A járvánnyal együtttjáró lezárásoknak, az otthoni munkavégzés gyakorlatának számos hatása máig érvényesül a peres gyakorlatban, akár pozitív, akár negatív értelemben. Pozitív, hogy a bíróságok, hatóságok felismerték az online kommunikáció lehetőségét, így a tárgyalások egy része a járványmentes időszakokban is áttehető az online térbe, időt és energiaráfordítást kímélve. Vegyes a megítélése annak a hozadékának, hogy a polgári peres tárgyalások perfelvétele körében a bíróságok az eddigieknél gyakrabban rendelnek el írásbeli előkészítést. Végül negatív, hogy a hirtelen megbetegedések miatti mulasztások kezelésében szinte mind a mai napig nem sikerült megnyugtató megoldást találni. A tanulmány a betegség miatti mulasztásokkal kapcsolatos gyakorlatot vizsgálja: a Kúria egy 2021. februári, a veszélyhelyzet sajátos körülményei közötti tényállás alapján meghozott végzésénének apropóján igyekszik megvilágítani, mi is a képviselethez való jog (valamint az ügyvéd helyettesítésének) valós tartalma, szerepe a polgári perben.
