It is obvious that it has as many advocates as opponents. While capital punishment has been declared against the law in many countries, it is still legal in the United States of America where there are several states that still use this method of punishment. “Thirty-six states, the Federal Government and the US Military retain the death penalty.” _1 It is hard to put the definition into words. Capital punishment is still an existing method when courts decide about people’s life and sentence them to death. In legal cases tried both by civilian (affecting both civil and/or criminal laws) and non-civilian trials. In addition to civilian trials, there is a special field of jurisdiction: death penalty can also be sentenced by the so-called martial courts. They have authority to try cases of any members or former members of the government or the armed forces whenever they commit a crime. They are judged under the Uniform Code of Military Justice, in which there are fourteen articles specifying offences and crimes that are punishable by death.
