dc.description.abstractThe present article concentrates on two aspects of the legal personality of water. First, it deals with the national legislation of New Zealand, especially the „Te Awa Tupua (Whanganui River Claims Settlement) Act 2017”, in which the legislator granted legal personality to the Whanganui River. Second, the article focuses on a Hungarian initiative concerning the establishment of a legal personality for the biggest Hungarian lake, i.e. Lake Balaton. Is it a real alternative to renew the legal protection of the environment in the Hungarian law? The article tries to launch a theoretical and practical dispute on the topic.en
dc.description.abstractAz új-zélandi Északi-szigeten található Whanganui folyó – a maori őslakosok által hivatkozott Te Awa Tupua néven – 2017-ben nyert önálló jogalanyiságot egy, az új-zélandi parlament által elfogadott törvényen (a továbbiakban: ATA) keresztül. Maga a jogszabály több szempontból is érdekes; ezek közül csupán az egyik, hogy a szövege Új-Zéland két hivatalos nyelvének, az új-zélandi angolnak és a maorinak egyfajta keveréke, vagyis nem két külön nyelvi verziója van a szövegnek (angol és egy attól elkülönült maori), hanem az alapvetően angol nyelvű szöveget gyakorta meg-megtörik a maori nyelvből átvett kifejezések. Ezzel egyúttal olyan érzetet kelt, mintha a 19. századi kapitalista alapokon nyugvó jogrendszerüket áthatná valamilyen ősi polinéz spiritualitás. hu
