dc.description.abstractIn der Praxis sind häufig Fälle anzutreffen, in denen das zuständige Gericht die anwaltliche Vertretung während des außergerichtlichen Verfahrens im Stadium des gerichtlichen Rechtsbehelfs nicht als eine mit Anwaltsgebühren vergütbare Leistung anerkennt und den Standpunkt vertritt, dass die Partei die in dieser Angelegenheit anfallenden Kosten selbst tragen muss und nicht auf die Gegenseite abwälzen kann. Die vorliegende Arbeit untersucht diese Anomalien im Zusammenhang mit notariellen Nachlassverfahren und Rechtsbehelfen im Zusammenhang mit Vollstreckungsverfahren durch Gerichtsvollzieher als zivilrechtliche Außerstreitverfahren und konzentriert sich dabei auf die gerichtliche Praxis. Ziel des Autors ist es, zu untersuchen, ob die derzeitige Vorgehensweise der Justiz mit den einschlägigen geltenden Rechtsvorschriften übereinstimmt oder ob eine Fehlinterpretation des Gesetzes vorliegt.de
dc.description.abstractIn practice, we often encounter cases where the court in charge does not recognise the legal representation provided during the non-litigation proceedings at the stage of the judicial remedy as a service that can be remunerated with attorney's fees and takes the position that the party is obliged to bear the costs incurred in this respect and cannot pass them on to the opposing party. The paper explores these anomalies in the context of the judicial remedies in relation to the notarial probate proceedings and enforcement proceedings by bailiffs as civil non-contentious proceedings, focusing on judicial practice. The author's aim is to explore whether the current approach of the judiciary is in line with the relevant existing legal provisions or whether there is a misinterpretation of the law.en
dc.description.abstractA gyakorlatban gyakran találkozunk olyan esetekkel, amikor a nemperes eljárás során, annak a bírósági jogorvoslattal érintett szakaszában kifejtett jogi képviseleti tevékenységet az eljáró bíróság nem ismeri el ügyvédi munkadíjjal honorálható teljesítményként és arra az álláspontra helyezkedik, hogy a fél a felmerült e tárgyú költségét saját maga köteles viselni, azt nem háríthatja át az ellenérdekű félre. A tanulmány a közjegyző által lefolytatott hagyatéki eljárás, és a végrehajtók által foganatosított végrehajtási eljárásokkal kapcsolatos bírósági jogorvoslatok, mint polgári nemperes eljárások kapcsán mutatja be az említett anomáliákat a bírói gyakorlatra fókuszálva. A szerző célja annak feltárása, hogy a judikatúra jelenlegi megközelítése összhangban van-e az irányadó hatályos jogszabályi rendelkezésekkel, vagy téves jogértelmezésről van-e szó.hu
