dc.description.abstract | Competition law aims to provide undistorted free competition in the market. In the earlier stages of competition law, public enforcement was implemented for fulfilling this goal. However, private enforcement had not been part of the European competition law, and it had not been discussed in the competition law practices until the 1990s. Finally, after Courage and Crehan and Manfredi cases, private enforcement issues have been accepted as a part of the EU competition. These decisions led to the approval of the Damages Directive. It has been accepted that victims who suffer losses because of the anti-competitive behaviours of the undertakings can claim their losses before the national courts. Even though injured parties can claim anti-competitive compensation issue has been clarified, the limit of the parties entitled to request compensation and how to implement the EU competition rules and domestic rules of the Member States is ambiguous. The Court of Justice of the European Union has elucidated these issues by judgements, such as the Kone case and Otis Case. However, these decisions have led to new debates concerning the scope of the parties entitled to claim compensation and the overdeterrence issue. This study examines the enlargement of the content of the parties who can request anti-competitive compensation and the debates regarding previous cases. | hu_HU |
