dc.description.abstractSmart contracts have been becoming a popular notion upon the major success of cryptocurrencies. However, considering the trade volume of the smart contracts in various commercial areas, questioning their legal aspects of them has been vital, in particular, de jure enforceability. Smart contracts are deployed by various blockchain platforms, Ethereum is one of the well-known platforms. However, before examining the legality and enforceability issues of the smart contracts, a technical overview of the blockchain, on the basis of Bitcoin cryptocurrency needs to be explained. Ethereum and Bitcoin are worldwide-known blockchain platforms, yet, they cannot be considered equal since their mechanism and areas of usage are not identical. Thus, within the scope of this work, the first section, will examine the general concept of the blockchain system, in particular, the very first cryptocurrency Bitcoin, and underline the relation between smart contracts and the blockchain-based technology. Subsequently, after technical explanations, it will be questioned the formation of smart contracts based on the general and common requirements in terms of contract law. ‘’Oracles’’ as a bridge between the real and virtual world are widely used in various sectors including the arbitration process. After giving the general outline of the arbitral process utilizing blockchain, normative approaches will be mentioned, and whether smart contracts fit under the existing legal framework will be put forward since the pseudonymous character, tamper-nature and automated execution of smart contracts might be complex to identify the legal effect of smart contracts. Within the scope of this work, ‘’enforcement’’will be examined from both computer science and legal perspectives which can be confusing when used interchangeably. Finally, after clarifying the legal relevancy of the smart contracts regarding whether they render contracts, the focus will be on the legal enforcement of the smart contract.hu_HU
