| dc.description.abstract | A dolgozat összefoglaló mű, amelynek témájában – tudomásom szerint – még nem született magyar nyelvű monográfia. Az intézkedések tárgykörében születettek összefoglaló munkák, amelyek azonban évtizedekkel ezelőtt íródtak, ennél fogva nem tartalmazhatják a legújabb változásokat és az aktuális problémákat sem. Dolgozatom célja a kényszergyógykezelés történetének, jelenlegi alkalmazásának, nemzetközi összefüggéseinek bemutatása, ahol az elméleti fejtegetések mellett hasznos következtetések is szerephez jutnak. Munka új tudományos eredmények hordozójává válhat azáltal, hogy egységes rendszerbe foglalja a kényszergyógykezelés jogintézményével kapcsolatos ismeretanyagot. Célom továbbá válaszolni arra a kérdésre, hogy a kényszergyógykezelésnek van-e helye a büntetőjogi szankciók között? Ha felteszem, hogy igen, választ kell kapni arra is, határozatlan vagy határozott időtartamú legyen a jogkövetkezmény, és hol történjen a végrehajtása? Vannak-e hasznosítható elemei a külföldi szabályozásoknak? Dissertation is a general thing; no Hunarian monography has been presented– as far as I know - in this topic. Theme of measures were in presented general papers, which were written decades ago, therefore these do not include the newest changes and actual problems either. The target of the dissertation presents the history, the application and the international connections of involuntary treatments in a mental hospital, in which they have a significant role of theoretical analyses and useful conclusion. The dissertation will become the source of new results, in this way it summarizes the factual knowledge in connenction with involuntary treatments in a mental hospital. My another target is to answer to the question that has a place the involuntary treatment in a mental hospital among the criminal consequence? If ’yes’, I must get an answer to the question that the consequence will be definite or an indefitite period, and where will the execution occure? Are there useful elemenets of foreign regulations? | hu_HU |
