This thesis analyzes how the question of abortion arose in America, while also examining the influences of both the federal and state powers to regulate it. The research gives a deeper insight into how the issue of abortion was introduced to Americans and shows their reactions to it. Since the thesis analyzes the two major U.S. Supreme Court cases, Roe v. Wade and the overturning of Roe v. Wade in 2022, the paper will give answers to how these litigations changed abortion regulations. That is why it is essential also to examine the power of the U.S. Supreme Court and the American Legal System since they symbolize the place in which abortion debates take place in. Before Roe v. Wade was introduced in 1973, women’s rights to seek abortion were not protected on a federal level, in some states abortion practices were illegal, thus the paper will examine the high number of criminal and unsafe abortions throughout America and people’s plans to change this, to make abortion safe for women in need. The importance of the Constitution is also investigated since Roe v. Wade gave women the right to seek abortion through the Fourteenth Amendment. Due to the overruling of Roe v. Wade happening last year, in 2022, the thesis also analyzes the immediate reactions and responses to it. Overall, the thesis tries to give an insight into the topic’s complexity, while questioning who -if anyone- has the right to regulate abortion practices.
