Freedom of establishment in the Internal Market – a prerequisite of the “European business”
Absztrakt
Nowadays it is crucial for the European Union to preserve its competitiveness in the global market. With this respect the Internal Market and its proper functioning is vital. The freedom of establishment allows businesses to be established in whichever Member State solely based on economic factors. The foregoing foster competitiveness of the EU globally. The European Court of Justice pointed out that it is not an abuse of the freedom of establishment to find a company in a Member State purely because the shared capital minimum is lower there as it is in the Member State where the company would like to operate in the future.
