| dc.description.abstract | This thesis analyzes the relationship between law and politics in international law through the prohibition of the use of force under the United Nations Charter. It examines whether this rule functions as a genuine legal constraint or is shaped by political considerations. The study explores the doctrinal framework of Article 2(4) and its exceptions, including self-defence and Security Council authorization. Through case studies such as the Gaza conflict and the killing of Qassem Soleimani, it evaluates how these rules operate in practice. It also considers structural limitations in enforcement, including the role of the Security Council and power asymmetries. The thesis concludes that while the prohibition retains strong normative authority, its application reflects an ongoing interaction between legal principles and political realities. | |
