International Contracts in the light of Brazilian Private International Law and the regulation of International Contracts in the European Union.

The Thesis aims to approach international contracts in the light of Brazilian International Private Law, with analysis of case law in accordance with Brazilian rules. The applicable law to international contracts been addressed by Brazilian jurisprudence was carefully worked on in the item related to case law, which sets out in a simple and objective way some decisions of the national Courts regarding the fulfillment of international contracts, usually of purchase and sale or transportation. The study proposes, initially, to present a brief history of Private International Law from the emergence of certain theories that sought to define a common method to the solution of conflicts between the law of the forum and the foreign law, as well as to analyze the regulation international contracts in the European Union. An analysis will be made about the typical aspects of the formation of international contracts, such as special clauses (hardship clause), the general contracting conditions, the standard clause, drawing attention to the fundamental differences between the contract domestic law and the international contract, and examine the importance given to international contracts within the scope of Private International Law.
