Knowledge is power…/ Scientia est potentia… The notion called ‘information asymmetry’ is when someone with the aware of certain knowledge or information can be capable to decide or act better, faster, or even cheaper in between certain conditions than the other party. Being the first in the world of business may lead to incomparable status. These advantages can not only realize in the economic sector. Only the future can answer that question what will be the outcome of the rapid technological innovation of the XXI. Century and where will be the borderlines of the new technologies applied by humans and being applied on individual. Thus, Radio Frequency Identification Chips contained sensitive personal information such as name, date of birth, medical status; sexual orientation can be a possible tool to identification or tracking individual without prior consent. All in all we shall state the legal tools and regulatory measures are not prefect, approaches of the law can treat the problem a posteriori or prevent entities from infringing the law, but beyond human commonsense (which is not enforceable by its nature) law is the best possible way to compound life situations fairly. In my thesis I was trying to envisage the possible or sometimes real threats of identity stealing, or malfunctioning of data process systems. I also tried to describe the risks and current legal tools (action plans, documents, principles, opinions) from the point of the European Union and outside of the Community.
