dc.description.abstractDolgozatom a bíró kizárásának elméleti, dogmatikai hátterét dolgozza fel. Vizsgálatomat kiterjesztem azonban az ehhez szorosan kapcsolódó területekre is. Mindenekelőtt foglalkozom a bírói ideállal és annak az idők soráni változásával, a kizárás jogintézményének történeti fejlődésével a büntető perben. Foglalkozni kívánok a tisztességes eljárás kérdéskörével, a bírók megítélésével a társadalomban, mely szorosan kapcsolódik a nyilvánosság kérdésköréhez is. Olyan alapvetések sem megkerülhetőek, mint az igazság kérdésköre, a bizonyítási teher, a funkciómegosztás, az officialitás és a pártatlanság viszonya, a bíró szervezeten belüli függetlensége, a bíróság szervezeti függetlensége, illetve a bírói függetlenség személyi garanciái. A bíró kizárásának hatályos törvényi szabályozásán túl áttekintem az irányadó hazai gyakorlatot iratvizsgálaton keresztül is, mely kapcsán nem mellőzhető az Emberi Jogok Európai Bíróságának (a továbbiakban: EJEB) és az Európia Unió Bírósága (a továbbiakban: EUB) idevágó joggyakorlatának összehasonlító elemzése sem, annak permanens vizsgálata mellett, hogy vajon kell-e és ha igen, akkor lehet -e egységesebbé tenni a bírói gyakorlatot ezen a jogterületen. Végezetül pedig kutatásom eredményeként igyekszem választ adni a hipotézisekben felvetett kérdésekre, jogalkotási javaslatok megfogalmazása mellett. My thesis deals with the theoretical and dogmatic background of the exclusion of judges. However, I extend my investigation to areas closely related to this. First of all, I deal with the judicial ideal and its changes over time, the historical development of the legal institution of exclusion in criminal proceedings. I wish to deal with the issue of fair trial and the assessment of judges in society, which is also closely related to the issue of publicity. Fundamental principles such as the issue of truth, the burden of proof, the division of functions, the relationship between officialdom and impartiality, the independence of judges within the organization, the organizational independence of the court, and the personal guarantees of judicial independence cannot be avoided. In addition to the current legal regulation of the exclusion of judges, I also review the prevailing domestic practice through a document review, in which context a comparative analysis of the relevant case law of the European Court of Human Rights (hereinafter: ECHR) and the Court of Justice of the European Union (hereinafter: CJEU) cannot be omitted, in addition to the permanent examination of whether judicial practice in this area of law should be made more uniform and, if so, whether it is possible to make it more uniform. Finally, as a result of my research, I try to answer the questions raised in the hypotheses, while formulating legislative proposals.
