This work presents a critical and universal issue “Migration” in its legal form. We will limit our study to the Mediterranean level, specifically the Tunisian-European relations. As known, Europe has been distinguished since the nineteens with its four free movements, among them, “free movement of persons”. This right was not generated for everyone, it was a European privilege. That’s why the European Union created a special mechanism through different agreements with its neighbor states, especially the ones around the Mediterranean such as Tunisia. This choice was accelerated because of the common elements that affect both parties in a significant way. It is about the cooperation and the encouragement of establishing an efficient legal framework that facilitates the legal movement through launching multiple projects, job opportunities, exchange programs, and diverse activities to prevent as maximum the disorder and the clandestine immigration. However, this problem persists despite the mutual effort from both sides. It has even got aggravated in the last years after the Tunisian revolution and the covid 19 pandemic. Tunisia is not only a departure country but also a transit country for different African nationalities that are seeking the European shores by the sea. In this situation, it is mandatory to keep on applying the human rights rules and help those immigrants despite their non-legalized actions as our humanity must prevail.hu_HU
