| dc.description.abstract | Értekezésem tulajdonképpeni témája a hányatott sorsú pótmagánvád intézménye, amely szerintem az ismételt bevezetése óta még nem találta meg a helyét büntető eljárásjogunk rendszerében – noha azóta az ítélkezési gyakorlat is igazolta létjogosultságát –, amit a jogelmélet, valamint a jogalkotás és jogalkalmazás közös adósságának tartok. Ezért olyan feldolgozási módszert kellett választanom, amely alkalmas lehet ennek a megvilágítására, az emiatti tematikai átfedések kockázatának vállalása árán is. The actual topic of my paper is the ill-fated institute of the substitute private prosecution, which in my opinion has still not found its place in the system of our Code of Criminal Procedure since it was put newly in force – although the practice of judgment already justified its validity –, and I consider this the common debt of law theory, legislation and the exercise of law. So I had to choose a method for processing which may shed some light on this, even taking the risk of the resulting thematic superimpositions. | hu_HU |
