dc.description.abstractMi az igazság? E kérdést teszi fel Szókratész Platón Az állam című utópiájában, mely mindmáig fontos és megoldatlan kérdése a filozófiai és a társadalmi gondolkodásnak egyaránt. A büntető igazságszolgáltatás területén azonban már nem pusztán az „igazság” fogalma, hanem önmagában az igazságkeresés fontossága és formája is attól függ, hogy melyik jogcsalád igazságszolgáltatási rendszerében járunk el. Abban a tekintetben egységesnek mutatkozik a szakirodalom, hogy a büntetőeljárásbeli igazságkereséssel kapcsolatban eltérő garanciális elvek mentén, két nyomvonalon szerveződnek az egyes jogrendszerek. Az alapvetően kontinentális hagyományokat követő rendszerek az igazságkereséssel kapcsolatos garanciaként azt hangsúlyozzák, hogy a büntetőeljárás eredményeként a valóságnak megfelelő, vagy legalábbis ahhoz nagyon közel álló tényállás megállapítása kívánatos. Ehhez képest az alapvetően angolszász hagyományok alapján szerveződő eljárásokban a felek által előadottak alapozzák meg a büntetőeljárásban megállapított tényállást, lehetővé téve akár alku lehetőségét is a tények vonatkozásában. A doktori értekezés e két nyomvonal mentén felépítve vizsgálja ezen igazságkeresési sajátosságok hatásait a tisztességes eljárás követelményére, s végső soron az igazságos döntésre. What is the truth? It is the question Socrates asks in Plato's utopia: The Republic, which is still an essential and unsolved question for both philosophical and social thought. Narrowing the dimension of the investigation to the field of criminal justice, however, it is no longer just the concept of "truth", but the importance and form of the search for the truth in itself, as well as its just method also depends on the justice system of which legal family we are acting in. There is consensus in legal literature that the basic concepts of criminal proceedings are structured along with different principles, actually on two paths. As a guarantee for the search for truth, the systems that follow continental traditions emphasize that it is desirable to establish a factual situation corresponding to reality, or at least very close to it, as a result of criminal proceedings. Compared to this, in proceedings based on Anglo-Saxon traditions, the facts presented by the parties form the basis of the facts established in the criminal proceedings. The parties are also entitled to bargain over the facts. The thesis, built along these two tracks, examines the effects of these truth-seeking characteristics on the requirement of a fair process and finally on a just decision.
