dc.description.abstractAz európai uniós védjegyrendszer reformja átfogó kutatásokon alapszik és számos jogelméleti, jogpolitikai vita előzte meg. A védjegyreform célja az volt, hogy a védjegyoltalom rendszert könnyebben hozzáférhetőbbé, egységesebbé, átláthatóbbá, biztonságosabbá, és rugalmasabbá tegye. A jogalkotó így akarta elérni azt, hogy az európai uniós védjegy a piaci verseny hatékony eszköze, s mint ilyen az egységes európai uniós piac megteremtésének egyik lényeges jogi eszköze is legyen. A kutatás célja megvizsgálni, hogy a védjegyreform által a védjegylajstromozást feltétlen kizáró okokra vonatkozóan bevezetett módosítások milyen hatással vannak az európai uniós védjegylajstromozási eljárás alakulására. A lajstromozást abszolút kizáró okok tanulmányozása arra is választ ad, hogy mi a feltétele annak, hogy bármely megjelölés leküzdhesse ezeket a jogi akadályokat és európai uniós védjegyoltalomban részesüljön. Az Európai Unió Bíróságának joggyakorlatának tanulmányozása megerősíti azt a nézetet miszerint a védjegyjog egy gyorsan, dinamikusan fejlődő jogterület, ahol a joggyakorlat szoros kapcsolatban áll a gazdasági fejlődéssel, az innováció, technológia és digitalizáció gyors fejlődése által életre hívott folyamatokkal. The reform of the EU trademark system is based on extensive research and has been preceded by a number of legal theoretical and policy debates. The aim of the trademark law reform was to shape the trademark system in order to become more accessible, uniform, transparent, secure and flexible. In this way, the legislator wanted the EU trade mark to be an effective instrument of market competition and, and an essential legal instrument for the creation of a single EU market, at the same time. The aim of the research is to examine the impact on the development of the EU trade mark registration procedure of the amendments considering the absolute grounds for refusal of registration introduced by the trade mark law reform. The study of the absolute grounds for refusal of registration will also provide an answer to the question of what is required for any sign to overcome these legal obstacles and obtain EU trade mark protection. The research based on the Court of Justice of the European Union case law confirms the view, that trade mark law is a rapidly and dynamically evolving area of law, where case law is closely linked to economic developments and to the processes brought about by the rapid development of innovation, technology and digitalisation.
